Being necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject. Article 5 of the Law regulates the conditions for personal data processing other than explicit consent in this way. It has also been demonstrated in the Board’s decision summaries that in camera monitoring activities, the obligation to clarify and the processes of obtaining explicit consent should be evaluated separately; and that camera monitoring for security purposes must comply with the principles of proportionality and relevance to the purpose.<\/li>\n<\/ul>\nSHARING OF YOUR PERSONAL DATA Your collected personal data may be transferred for the purposes of: a. Ensuring your personal security and Company security, b. Execution of emergency management processes, c. Execution of occupational health and safety processes, d. Resolution of legal disputes, e. Presentation as evidence in a possible dispute, f. Providing information to judicial and administrative authorities, relevant law enforcement agencies, and authorized persons, institutions, and organizations upon request in accordance with relevant legislation, g. Execution of internal audit, investigation, and inquiry processes, h. Execution and supervision of business activities, i. Execution of risk management processes, j. Ensuring the security of data controller operations, and when necessary, within the framework of personal data processing and transfer conditions specified in Article 8 of the KVKK Law, to authorized public institutions and organizations, legal advisors, authorized persons and organizations involved in audit processes, and technical infrastructure\/maintenance-repair suppliers from whom services are received, limited only to the service provided. In case the camera recordings require maintenance, repair, security infrastructure support, technical examination, or systemic storage, it may be shared with the suppliers from whom we receive services, only to the extent of the need and the scope of the service.<\/p>\n
STORAGE AND DESTRUCTION OF YOUR PERSONAL DATA Our company stores the personal data it processes for the periods determined by legislation, and if no specific period is determined in the legislation; personal data is kept for as long as the applications, operational needs, security requirements, and the customs of commercial life require its processing in connection with the services our Company offers while processing that data. After the expiration of this period, the data may be stored only to the extent necessary to serve as evidence in possible legal disputes. After the expiration of the specified periods, personal data is deleted, destroyed, or anonymized at the first periodic destruction date in accordance with Article 7 of the KVKK Law and the provisions of the relevant secondary legislation. The obligation regarding the deletion, destruction, or anonymization of personal data is clearly regulated by Article 7 of the Law.<\/p>\n
YOUR RIGHTS REGARDING THE PROCESSING OF YOUR PERSONAL DATA Within the framework of Article 11 of the KVKK Law, you can apply to our Company and convey your requests listed below: a. To learn whether your personal data is being processed, and if so, to request information regarding this, b. To learn the purpose of processing your personal data and whether they are used in accordance with their purpose, c. To learn the third parties to whom your personal data is transferred domestically or abroad, d. To request the correction of personal data in case it is processed incompletely or incorrectly, e. To request the deletion, destruction, or anonymization of your personal data in the event that the reasons requiring the processing of your personal data disappear within the scope of Article 7 of the KVKK Law, f. The minimum elements that must be included in the applications to be made to the data controller and the thirty-day response period are regulated in the Communiqu\u00e9 on the Procedures and Principles of Application to the Data Controller. For a person other than the data subject to make a request, there must be a notarized special power of attorney issued on behalf of the person who will apply by the data subject regarding the matter. In this context, your requests that you submit to our Company in accordance with the procedure will be concluded within thirty days at the latest. If your requests require an additional cost, a fee will be charged to the applicant by our Company according to the tariff determined by the Personal Data Protection Board. If our Company responds to your application via a recording medium such as a CD or flash drive, a fee may be charged not exceeding the cost of the recording medium. This fee framework is regulated in the Communiqu\u00e9. Our company may request information from the data subject to determine whether the person applying is the personal data owner; it may ask the data subject questions regarding their application in order to clarify the matters stated in the application. In accordance with Article 14 of the KVKK Law, the personal data owner may file a complaint with the Board within thirty days from the date they learn of our Company’s response, and in any case within sixty days from the date of application, in case the application is rejected, the answer is found insufficient, or the application is not answered in due time.
